Terms of Sale
Last updated: 29 October 2026
1. About us
1.1 This website (rackfoundry.co.uk) is operated by Lloyd Byatt, a sole trader trading as RackFoundry ("we", "us", "our").
1.2 Trading address: 6 Bittern Drive, Biggleswade, Bedfordshire, SG18 8DU, United Kingdom. Email: [email protected].
1.3 VAT: we are not registered for VAT. Our prices do not include VAT and we do not charge it, so we cannot issue VAT invoices and we do not have a VAT number. We will issue a standard receipt or invoice on request.
1.4 These terms apply to every order you place with us. Please read them before ordering. Section 12 contains extra terms that apply only if you buy as a business.
2. Our business model
2.1 We work with established UK trade suppliers and distributors. Most orders are dispatched directly to you from our UK supply partners, not from our own premises. A small number of items (for example some DeskPi RackMate products) are dispatched by us from our own UK stock. A kit may arrive in more than one delivery if its parts come from different suppliers.
2.2 This does not change your rights. Your contract is with us, and we are responsible for the goods and for handling any problem.
3. Products and information
3.1 We describe products, dimensions, depths, screw types and compatibility as accurately as we can, using manufacturer and supplier information. Where a detail has not been confirmed we mark it "TBC". Images are for illustration and finishes may vary slightly.
3.2 Our online configurator is a guide to help you choose. Please check your own equipment's dimensions before ordering. If you are unsure, email us before you buy.
3.3 Products are intended for use in the UK. Electrical items supplied to you come with UK BS1363 plugs unless stated otherwise.
4. Prices and payment
4.1 Prices are shown in pounds sterling (GBP). As we are not VAT registered, the price shown is the full price of the goods: no VAT is added.
4.2 Delivery to UK mainland addresses is free on orders of £100 or more; orders under £100 pay a flat delivery charge of £9.95. The delivery charge is shown before you pay. The total you pay is shown at checkout before you confirm your order.
4.3 Payment is taken at checkout by Stripe. We accept the payment methods shown at checkout. We never see your full card details.
4.4 If we have made an obvious pricing error, we will contact you before dispatch. You can then either confirm the order at the correct price or cancel for a full refund.
5. How the contract is formed
5.1 When you place an order you will receive an email acknowledging it. This is not acceptance.
5.2 The contract is formed when we email you to confirm that your order has been accepted or dispatched, whichever is sooner.
5.3 We may decline an order, for example if an item is unavailable from our suppliers, the delivery address is outside our delivery area, or we suspect fraud. If we do, we will tell you and refund you in full.
5.4 If an item becomes unavailable after you order, we will tell you promptly and offer you a refund or a suitable alternative, at your choice.
6. Delivery
6.1 We deliver to UK mainland addresses only at present. See our Delivery Information page for areas we cannot currently serve, typical lead times and how large items are delivered.
6.2 Delivery times are estimates. If we fail to deliver within 30 days of the contract (or any date we agreed), you may treat the contract as ended and get a refund, as set out in the Consumer Rights Act 2015.
6.3 Many items, especially cabinets and pallet deliveries, need a signature. Large cabinets are usually delivered to the kerbside. Please make sure someone can receive the delivery and that you have help to move heavy items.
6.4 Risk in the goods passes to you when they are delivered to you or to someone you nominate. Ownership passes to you when we receive full payment.
7. Your right to cancel (consumers)
7.1 If you are a consumer, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel your contract within 14 days without giving a reason.
7.2 The cancellation period ends 14 days after the day you (or someone you nominate, other than the carrier) receive the goods. If your order is delivered in several parts, it ends 14 days after the day you receive the last part.
7.3 To cancel, tell us clearly before the period ends, by email to [email protected] or by post to 6 Bittern Drive, Biggleswade, Bedfordshire, SG18 8DU, United Kingdom. You can use the model cancellation form in our Returns and Refunds policy, but you do not have to.
7.4 You must send the goods back, or hand them to us or our collection partner, without undue delay and no later than 14 days after telling us you are cancelling.
7.5 Return costs: unless the goods are faulty or not as described, you pay the direct cost of returning them. Some items, such as floor-standing cabinets and pallet deliveries, cannot normally be returned by post. Our Returns policy gives an estimate of the maximum cost of collecting these items.
7.6 We will refund the price of the goods and the cost of standard delivery (if you paid for a more expensive delivery option, we refund only the standard rate). We will refund within 14 days of receiving the goods back or of you supplying evidence that you have sent them back, whichever is sooner, using the same payment method.
7.7 You may handle the goods only as you would in a shop to check their nature, characteristics and how they work. We may reduce your refund to reflect any loss in value caused by handling beyond that, for example fully assembling a cabinet and drilling or fixing it to a wall.
7.8 This right does not apply to business customers.
8. Faulty goods and your statutory rights (consumers)
8.1 Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described.
8.2 If goods are faulty, you have:
- up to 30 days from delivery to reject them for a full refund;
- up to 6 months to ask for a repair or replacement. If that fails or is not possible, you can get a refund or a price reduction. During this time, we must prove the fault was not there at delivery;
- up to 6 years (5 years from discovery in Scotland) to claim, although after 6 months you may need to show the fault was present at delivery.
8.3 Please tell us about a fault as soon as you can, ideally with photos. We will arrange collection or return at our cost for faulty goods.
8.4 Damage in transit: please check deliveries on arrival and note any visible damage on the courier's paperwork. Report damage or missing items to us within 48 hours of delivery if you can, as it helps us claim from the courier. This does not limit your statutory rights.
8.5 Nothing in these terms affects your statutory rights.
9. Manufacturer warranties
Some products come with a manufacturer's warranty. This is in addition to, and does not replace, your statutory rights. We will help you make a warranty claim.
10. Installation and use
10.1 We supply goods only. We do not install racks, cabinets or electrical equipment.
10.2 Wall-mounted cabinets must be fixed to a wall able to carry the cabinet and its contents, using suitable fixings. Respect the published load ratings. If you are unsure, use a qualified installer.
10.3 Do not exceed the rated load of PDUs (13A per UK plug) and follow the manufacturer's instructions.
11. Our liability (consumers)
11.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
11.2 We supply products for domestic and private use. If you use them for commercial purposes, we have no liability to you for loss of profit, business, business interruption or business opportunity.
11.3 We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights.
12. Business customers
This section applies if you buy for purposes relating to your trade, business, craft or profession (including sole traders, companies, schools and public bodies). Where it conflicts with the rest of these terms, this section applies.
12.1 No cancellation right. The 14-day cancellation right in section 7 does not apply. We may accept the return of unused goods in their original packaging by agreement. We do not charge a restocking fee, but you pay return carriage, and we may reduce the refund to reflect any loss in value caused by handling the goods more than needed to inspect them.
12.2 VAT. We are not VAT registered, so we cannot issue a VAT invoice and no VAT can be reclaimed on our invoices.
12.3 Quotes and purchase orders. Written quotes are valid for 14 days unless stated otherwise. Orders placed by purchase order are accepted only when we confirm them in writing. Unless we agree credit terms in writing, payment is due in full before dispatch (proforma).
12.4 Inspection. You must inspect the goods on delivery and tell us of any damage, shortage or non-conformity within 3 working days of delivery. Defects that are not visible on inspection must be reported within a reasonable time of discovery.
12.5 Faulty goods. The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 apply. If goods are faulty, we will, at our option, repair, replace or refund them. This is your sole remedy for faulty goods, except as set out in 12.7.
12.6 Limitation. Subject to 12.7, we are not liable for any loss of profit, revenue, data, business or goodwill, or for any indirect or consequential loss. Our total liability to you under or in connection with any order is limited to the price paid for that order.
12.7 Nothing limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited by law.
13. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as supplier or courier disruption, severe weather or strikes. We will tell you as soon as possible and, if the delay is significant, you can cancel for a refund of anything paid for goods not received.
14. Complaints
Please email [email protected] with your order number. We aim to respond within 2 working days and resolve complaints within 14 days.
15. Other terms
15.1 We may update these terms; the version in force when you ordered applies to your order.
15.2 If a court finds any part of these terms invalid, the rest will still apply.
15.3 These terms are governed by the law of England and Wales. Consumers may bring proceedings in the courts of England and Wales, or, if they live in Scotland or Northern Ireland, in their local courts.
